Mansfield Bankruptcy Law Attorney
Do not spend all your money and sell all your possessions before filing for bankruptcy. It is not necessary. Speak with one of our Mansfield bankruptcy law attorneys before you make any major financial decisions. We can assist you with asset protection and real property protection. There are exemptions to bankruptcy that may save your home, your car, your IRA, and your 401(k). There are state and federal exemptions that protect these assets.

At Midgley Legal Services, we are a debt relief agency, in practice since 1987. We have been through decades of changes in bankruptcy laws. We can assist you with understanding how bankruptcy affects your life. Under the new bankruptcy law, you should not be concerned about meeting the requirements to file for bankruptcy. A majority of people continue to qualify for Chapter 7. Only a few with high income may be required to file for Chapter 13. For more information on how we may be of assistance, contact our law office for an appointment.

Chapter 7
Chapter 7 is liquidation bankruptcy. Under personal bankruptcy provisions a person may keep all exempt property and discharge all debt, except child support is never eliminated and student loans are eliminated only in hardship situations. It will automatically stop creditor harassment. If you are a business filing Chapter 7 you can discharge most debts owed by the business. If you are one of the few who do not qualify for Chapter 7 you may file Chapter 13.

Chapter 13
Chapter 13 is generally advised for higher income individuals. Chapter 13 is perhaps the best way to prevent a home or other assets from being taken or liquidated by creditors. The homestead exemption is valued up to $500,000. Filing for Chapter 13 can stop foreclosure of your home or repossession of your vehicle. The court forces creditors to work out payment plans with the debtor. Plans stop interest and penalties and set a payback period of three to five years. Chapter 13 can be a solution to income tax issues as well. Chapter 13 also allows child support arrearages to be repaid.

Chapter 11
Chapter 11 bankruptcy is business reorganization. Businesses are allowed to discharge debt they cannot pay or reorganize to provide business success, if approved by the Court.

If you are considering bankruptcy, but are uncertain of which Chapter is best suited to your interests, contact Midgley Legal Services to speak to a friendly and experienced Mansfield bankruptcy law attorney.
